Terms of Service

DispatchTool provides navigation guidance for commercial trucks. Routing data, low-bridge alerts, weight restrictions, hazmat warnings, traffic, and ETAs are estimates and may be incomplete or out of date. You — the driver — are solely responsible for safe vehicle operation, for verifying that any route is appropriate for your truck, and for complying with all road signs, posted restrictions, and traffic laws. Do not interact with the app while driving.

These Terms of Service ("Terms") govern your use of the DispatchTool app, website, and services (collectively, the "Service") operated by DispatchTool, 501 North Christopher Columbus Blvd, Unit 1420, Philadelphia, PA 19123. By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

DispatchTool offers truck-safe navigation, dispatching, document handling, invoicing, broker check-call, and related tools for owner-operators, drivers, and small fleets. Some features are free; others require a paid subscription.

Truck-safe routing is a guidance tool, not a guarantee. Map, restriction, weight, height, hazmat, fuel, parking, and traffic data come from third parties (including TomTom and HERE) and may be incomplete, inaccurate, or out of date. You must independently verify that any route is legal and safe for your specific vehicle, load, and licensing. We are not liable for citations, fines, damage, or injury arising from following or relying on the Service.

You retain ownership of your location data. By starting navigation, you grant us a limited license to process your location to provide the Service as described in our Privacy Policy. If you choose to share a trip with a dispatcher, broker, or shipper, you authorize us to share your real-time position with that party until the trip ends or you stop sharing.

You own the loads, documents, photos, and messages you upload. You grant us a license to host, transmit, and display this content solely to operate the Service for you. You are responsible for the legality of content you upload.

The Service may link to or integrate with third-party services (load boards, factoring, ELD providers, repair providers). Use of those services is governed by their own terms. We are not responsible for third-party services.

You may terminate at any time by deleting your account in Settings → Account. We may suspend or terminate accounts that violate these Terms or that pose risk to the Service or other users.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT NAVIGATION DATA IS ACCURATE OR COMPLETE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DISPATCH TOOL AND ITS PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $100.

You agree to defend and indemnify DispatchTool from claims arising out of your use of the Service, your content, or your violation of these Terms or applicable law.

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law rules. Disputes will be resolved in the state or federal courts located in Philadelphia County, Pennsylvania, except where applicable consumer law gives you the right to file in your local courts.

For users who download the iOS app from the App Store: Apple is not a party to these Terms and is not responsible for the Service or any claims relating to it. Apple is a third-party beneficiary of these Terms and may enforce them against you. The license granted is a non-transferable license to use the app on Apple-branded devices that you own or control, subject to the App Store Terms of Service.
